Warranty Agreement

Gopal Enterprises hereby agrees to provide a limited warranty for a period of 5 years, 10 years or 15 years for Nirnay, Nirnay Plus and Nirnay Prime respectively to Customer.

Definitions:

1. Film integrity shall be defined as the absence of peeling, chalking, chipping or cracking, except for such slight crazing or slight cracking as may occur on tightly roll-formed edges or brake bends at the time of roll forming pre-painted sheets or coils

2. Chalk or Oxidation shall be defined as a numerical rating as warranted when measured in accordance with the standard procedures specified in ASTM D 4214-98

   Limited Warranty is subject to the following conditions:

   1. The coated metal must not be cleaned with abrasive or chemical cleaners and any infiltration due to improper packing including the paint protection film
   2. In the event of a claim under this limited warranty, warranty holder must supply documentation that the product in question demonstrates to the reasonable satisfaction of ‘Gopal Enterprises’, that the failure of the Product was due to a breach of the limited warranty stated herein
   3. Original Invoice Copy must be provided for any claims to be made for warranty purposes, also batch number of the product supplied shall be as that on the invoice

   Limitations:

   1. The limited warranty shall be applicable in case the product is installed within 10 days of date of supply.
   2. Non-uniform color changes that result from unequal exposure of roofing, sidewall or trim panels to sunlight and/or the elements are not covered by this warranty
   3. Any change in color which is natural due to the age of the product or caused due to debris does not account for warranty.
   4. Any damage caused by the direct or indirect contact with the fasteners or sealants is not covered in warranty.
   5. The backside of the product is not covered under warranty.
   6. All the costs with respect to dismantling, installation, transportation shall be solely on account of Buyer and the Company shall not be responsible for the same.
   7. The warranty does not cover any direct or indirect contact with lead, copper or any other metal surface which can cause damage to the product.
   8. Any damage caused due to the water clogging in the sheets while storage is not covered under warranty.
   9. The warranty does not cover any damage caused by the Paint protection film if not removed after installation within 1 day.
   10. This limited warranty does not extend to, or cover:
       • Damage to the Product occasioned by improper storage of the coated metal prior to installation or improper repackaging, handling, shipping, processing and/or installation;
       • Damage to the Product that suffers from improper forming, fabrication, cut edge exposure and any other condition like embossing that causes coating degradation
   11. This limited warranty does not cover damage or failure of Product in which damage or failure is attributable to acts of God, falling objects, external forces, explosions, fire, riots, civil commotions, acts of war, radiation, or other or such similar dissimilar occurrences beyond ‘Gopal Enterprises’ control.
   12. This limited warranty is extended to Warranty holder only and shall not inure to the benefit of any other party. ‘Nirnay ’name, trademark, or limited warranty shall not be used in any warranty given by the Customer (Warranty holder) to their customers. This limited warranty is non-transferable and non-assignable by Warranty holder, and Warranty holder shall not permit their agents, representatives, customers, distributors, applicators, or contactors to claim, represent, or imply that this limited warranty extends to or is available to anyone other than Warranty holder
   13. Except as set forth herein, ‘Gopal Enterprises’ makes no other warranties with respect to the product, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose of the product

WARRANTY

The durability of the paint supplied to warranty holder will be guaranteed to according to the applicable warranty offered for the specific product for residential, commercial and school building used for habitation, distribution centers, hotels, shopping malls, office buildings assembly factories and schools located in rural or residential areas. This warranty excludes industrial steel mills, power generating stations, oil fields, oil refineries, ore mines, chemicals plants, paper mills or other unusual environmental exposure, including marine exposure within 10km of saltwater. This warranty only applies to the following conditions:

REMEDY

1. After due process of registering complaint within aforementioned timeframe, Gopal Enterprises may depute relevant personnel for due diligence, including comprehensive examination of product and all related factors that may have an impact on product performance
2. Within a period of fifteen (15) working days, the result of the examination shall be shared with the Customer in writing by Gopal Enterprises representative. If it is determined that the product meets all conditions set forth in this document and despite that does not meet performance standard, Gopal Enterprises will suitably provide a solution for repair or replace of the material within additional fifteen (15) working days, subject to availability of material and valid only for Customers in India.
3. In the event of any repair or replacement by Company of the Product, the warranty shall stand extinguished and cancelled. The decision of the company shall be final and binding on the Buyer.
